
In-lieu fee (ILF) programs represent an innovative approach to mitigating functional loss from impacts to aquatic resources. The Watershed Company and Chelan County are completing one of Washington State's first ILF Program Prospectus and Instruments under a new 2008 federal rule governing compensatory mitigation. The In-Lieu Fee Program will provide a mitigation alternative for projects on and near lower Lake Chelan, allowing permittees to pay into a fund that finances mitigation projects in the watershed. For sites where conventional techniques of on-site, in-kind mitigation are not possible, permittees will be able to purchase mitigation credits through the program. The ILF Program Prospectus describes the process and service areas in detail, while implementation is governed by the ILF Program Instrument.
